Which way to the future?..oh that’s right, forward (Part 1)

Often in my youth I contemplated things that seemed to me to be unfair or even blatently one-sided and I remember asking older, wiser and much more learned people why things are this way.  On several occasions I heard the same answers “that’s just how it is” or “some things will never change” and my personal favourite “it’s complicated”.  All were (unfortuantely) true answers to a simple question.  It seemed that was just how it was or that it has been this way since anyone can remember and so it will probably stay this way forever.  Now hold that thought and bear with me for just a few moments I am actually making a point.

It would seem that Vic Toews has found himself in a bit of a predicament the last few weeks.  The Minister of Public Safety for Stephen Harper’s Conservative government has been arguing the logic behind the rather unpopular and intrusive C-30 bill.  The bill is apparently being introduced to help law enforcement fight child pornography on the internet.  There would seem to be more than a few fundamental issues with the bill itself including some that Mr. Toews wasn’t even aware of.    Beyond the fact that NOWHERE in the bill is child pornography mentioned it opens up the private online lives of Canadians to authorities that may or may not misuse or leak the personal information they discover.  This is a very unsettling thought for those of us that carry on our lives online, some private and some public.

You see one main issue here is CHANGE and how some in power (at least perceived) wish to fight that change.  You know that saying “money makes the world go ’round”, well it’s less true today and actually a bit different.  That money is for the most part 1′s and 0′s that exist on a complex network of wires and servers and THAT is what MAKES that money go ’round, indeed it is often what makes that money exist at all.  Those that know how this network called the internet work are ACTUALLY the ones that control the money, ergo if you control the network you control the money.  Now think about this, information is in fact the more important currency as the more information one has the more one can control the people or more importantly the actions of those people that believe they have this money.  Having said this let us now entertain a few more possibilities.

For generations lobbyist’s have for the most part controlled the decisions governments make.  You see, most lobby groups are usually very well funded by private interests and corporations and they in turn attempt to “persuade” government policy to meet their own agenda.  This is “just how it is”, right!  I would like to put forth that there is a new group/procedure to lobbying and one of those groups or at least by far the most public is called Anonymous, and they are changing the rules.  Anonymous (@annonymous for Twitter users) is actually not a group of people per se but rather a philosophy.  There are tens of thousands of these like minded individuals out there (typically younger and VERY tech savvy) that have watched as the current governments and corporations have pushed around people with less influence and money, probably their own parents and frankly are sick and tired of it!  Lobbyists have money, there is no doubt about that but the NEW lobbyists (like Anonymous) have (or can quite easily acquire) INFORMATION and if my earlier theory proves proper then LOOK OUT! because it’s about to get much more interesting “up in here”!

The internet has become a great equalizer for many groups whose voices may not previously have been heard, or rather ignored altogether.  Openmedia.ca has used the power of the internet to help change the way people are unfairly billed for usage and brought about a truer sense of net neutrality for Canadians.  Blogs have given a voice to people online whose writings would never have made it into the mainstream media for various reasons.  You can imagine how disturbing this is for those establishments that have historically made decisions and created policy all the while knowing the general population had little to no recourse.  Perhaps governments and corporations got lax in their comfy little worlds where people were just a delivery system for their grand fortunes and seemingly unlimited power.  Generations have watched and read what has in my opinion become censored/controlled media and been bombarded with marketing messages that helped bring about a disasterous economic crash that will take generations to recover from.  I often wonder if the missive of governements and corporations is “shut up and buy stuff”.

The winds of change are blowing hard against those that have lived in relative comfort of their fortunes and ability to control things around them.  Problem is the winds are changing direction.  In Part 2 of this blog I will discuss more of those changes and what they mean to us as Netizens and occupants of the planet Earth.

I read an outstanding article this week that talked about how piracy will not kill the entertainment industry and I would like to expand on that a bit.  I want to make it clear that I am not in agreement with (internet) piracy any more then I am in agreement with blatant avarice.  Both are wrong and yet seem to have woven themselves into our cultural fabric.  The difference is internet piracy has not been around since the dawn of time.

The entertainment industry is VERY obviously behind the times in many aspects of its product delivery, there is no substantial argument against this FACT.  So indeed the issue may lie not in the greed or desire of the so called pirate but rather in the ineptitude of an industry run by people trying to do things “the same old way”.  This industry has been given a great gift in the last 10-12 years but REFUSES to see the forest for the trees.  If people are downloading the music whether paid or not it means they WANT it, they are telling you they like your work but the pricing and delivery method SUCKS!!

If this industry would be more flexible in its system of delivery i.e. allow me to download when/what I want at a REASONABLE fee then we would all be happy.  I am not so naive to believe this would stop piracy in its tracks but I am darn sure it would put more money into the pockets of the entertainment industry and satisfy a boat load of consumers.  It is my contention that the main issues here  are control and greed.  The entertainment industry is a business like any other and therefore must turn a profit to keep shareholders and the government happy, this is agreed.  The question is how much is enough?

Number one I am not so sure the entertainment industry is suffering as bad as they claim.  There is even a Wikipedia article about what is known as Hollywood Accounting. If this is news to anyone in our government then I feel we are being governed by people that are woefully inept.  The entertainment industry has for decades claimed  new technologies would destroy their business and yet Johnny Depp owns an island and John Travolta has a small fleet of personal planes so I cannot believe the industry has done as bad as they would like us to believe.  Remember when tape cassettes were destroying the music industry and how about VHS destroying the movie industry.  Well that didn’t turn out the way they thought eh!  These industries unfortanetly for us are run by archaic non-progressive individuals who fail to see (or accept) a changing landscape of their business and wish only to keep things static in hopes the world around them will keep them relevant..NEWS FLASH!! IT ISN’T GOING TO HAPPEN!

The so called anti-piracy bills will do the same thing to downloading as prohibition did to alcohol..move it underground.  These legislative bills will do no more then waste tax payer dollars and create a thriving underground that has the ability to morph much faster then any law can.  So rather then try to legislate the problem out of existence why not ask the entertainment industry to catch up with the times.  Show them how they can use the data from pirating sites to make the next big blockbuster movie.  Along with this keeping the pricing of their products within a decent range and releasing QUALITY MATERIAL would help greatly..I mean Saw 3D..SERIOUSLY!!

I guess what I am trying to say is, much like our legislators the entertainment industry is very very very far behind in understanding who their audience is or people in general for that matter.  Again, much like our legislators they are OUT OF TOUCH with the general public and in turn cannot comprehend what is happening around them.  I often picture entertainment execs (and our Parliament members) sitting in a room with their hands over their ears screaming  “LALALALA” in hopes they can drown out the real world.  Then again when you let your own PERSONAL AGENDA be your sole decision making tool you do tend to ignore EVERYONE/EVERYTHING ELSE! (are you listen Conservative Government).

This is the last post in my series of 3 and I hope at the very least it has brought you to a place where you might start to wonder “what should I do next?”  We must stand up as Canadians, proud of our rights and freedoms and stop our government from handing our privacy and our lives over to private interests.  We must PROTECT FUTURE GENERATIONS from the cronyism taking place at this very moment.  Write, call, then picket your local MP and tell them you want to keep your private life private and you don’t want the government or anyone else reading your email, listening to your phone conversations or watching where you go on the internet.  Some things are meant to be just ours.  They already take the lionshare of our income don’t let them take our rights as well!!

Seven years ago last month I brought my first child home from the hospital.  I will never forget the first time I watched him sleep and wondered “who is this little person I just brought to my house?”  I love my children dearly and will do anything to see them safe and happy.  I am no different from every other parent looking out for the best interests of their family.

Perhaps this is the main reason I am so wary of our government doing something that seems so one sided and undemocratic.  To make it clear I am not concerned about the piracy/copyright issues as it were.  I am not FOR piracy but at the same time think that Bill(s) C-11 and C-51 will do too much to people that have nothing to do with piracy or copyright infringement whatsoever such as my children.  Bills like these are a sore spot for me as I see them as “door openers” for other much more oppressive acts of legislation in the future.

Right now we are witnessing a most heinous abuse of “democracy” and most people are unaware of it.  The Patriot Act has given the U.S. govt very broad and sweeping powers over how people’s rights and freedoms are treated (or mistreated).  This is the path I want to avoid in Canada especially if it is solely in the interest of making rich corporations even richer and giving our government the ability to spy at the demise of my family’s freedoms and privacy.  Bill(s) C-51 and C-11 will do exactly this or at the very least they will get the ball rolling.

These bills (in my opinion) are not about piracy or even copyright, they are about CONTROL!  I am going to put it out there at the risk of sounding a little “conspiracy theory” here.  Would it be in the interest of our government to control our flow of information and “keep us safe” from that which may not be in their our best interest.  By passing this legislation they would be on a road to complete control of the internet thus the control of the largest flow of information on the planet.

Me:..umm no, apparently the government censored that feed.  But one of the Kardashians is using a different lip liner…I know RIGHT!!”

 

The thought of having my children raised in a country where they cannot watch a 2 min video of a lizard running across water due to “copyright infringement” frankly pisses me off in a way I cannot describe.  Parents out there should try to learn more about these bills and think what they will mean to our children.  Stifling creativity and curbing halting access to information that is not mainstream or in the interests of an elected official or lobby group is not how our children will grow as people.

It shouldn’t happen here (Part1)

As I watch my children playing and doing those things children will do I am forced to think back to my own childhood and remember what it was like to be so free of worry.  While I was by no means a sheltered child I was at the same time unaware of the bigger concerns of adults like employment, bills, crime and that stuff that got in the way of living care free.  Sadly I must now add to that list of concerns the very civil liberties that my grandfather went overseas in WWII to protect.

The Conservative government under the leadership of Prime Minister Stephen Harper has introduced (in various incarnations) several bills (wrapped in the non-invasive sounding Omnibus crime bill) that if passed will relieve Canadians of their worry about living in a free and productive/progressive society, because for the most part it will no longer exist.  I speak of BillC-11 and Bill C-51 the “Lawful Access” Bill our government wishes to pass which will give law enforcement the ability to, in my opinion spy on Canadians that use the internet.  Bill C-51 is a bill which would:

“make it mandatory for telecoms providers, ISPs and search engines to disclose subscriber information, including name, address, IP address, and email address, to law enforcement officials without court oversight. It would also require costly upgrades to these networks to enable new surveillance capabilities.”  -Dwayne Winsecks Media Blog

Perhaps just reading it like this does not seem so bad until you get to the part that says “without court oversight”.  This means that law enforcement will NO LONGER REQUIRE A WARRANT to retrieve your personal information from your Internet Service Provider ie. Bell, Rogers, TekkSavvy.  These few words have been enough for academics like Michael Geist and reporters like Chase Kell to report about what the implications of this will mean to Canadian’s civil liberties and the technology industry in Canada.  Open Media is an online organization interested in keeping the internet  affordable, free and accessible. They also happen to be strongly opposed to Bill C-51.

Mr. Geist hit the nail on the head when he said:

“Canadians deserve better than deceptive claims and divisive name-calling. They deserve real judicial oversight before their personal information is disclosed and, given the costs (financial and otherwise), they deserve a full accounting on why lawful access is needed.”

Stephen Harper does not seem to think these things matter that much to Canadians.  It would appear Mr. Harper would be more than happy to pass a law that could potentially open the door for others like it that would erode other liberties Canadians have enjoyed for generations. What would stop a BULLY like Stephen Harper from one by one eliminating Canadians freedoms until ultimately they are all but faint memories, and to what end.

The internet is the largest free flowing source of information and entertainment in history.  Perhaps therein lies the problem for corporations and governments alike.  Is it conceivable that these institutions would be happy to have a “dumbed down” and ill-informed population of mindless consumers to line their pockets and be kept controlled.  We have just in the last year witnessed social change around the world in the form of revolution (government gets nervous) and corporations being held accountable for their actions (PEOPLE get in the way of profit).

I am not writing this to incite any revolution or even start a personal campaign against corporate North America.  I wish only to inform my fellow Canadians and make them aware of what is happening in our country.  Stephen Harper is an elected official, a public servant and he is charged with doing what is BEST for ALL CANADIANS and not what will satisfy  the governments of other countries (the U.S. Government would LOVE to see these bills pass) or some billion dollar corporations (the entertainment industry).

I ask that readers of this post take the time to visit the links I have placed throughout and inform themselves as much as possible.  Talk to others in the know about what these bills will mean to the rights and freedoms you enjoy today.  Let us not in 20 years be forced to look back and fondly remember what we HAD and say “..if I only we had done more.”
